The STJ (Superior Court of Justice) will broadcast live the trial session of the Italian government’s request for former player Robinho to serve a sentence in Brazil. The trial is on the agenda of the court’s Special Court session scheduled for the 20th, starting at 2 pm.

The session will be in person and broadcast on the STJ YouTube channel.

Robinho was convicted of gang rape. The former football player received a nine-year prison sentence from the Italian courts, but is free in Brazil, whose legislation prevents the extradition of native Brazilians.

The judgment at the STJ will be on the request for approval of Italy’s sentence. With the approval, Italy asks that the former athlete serve the sentence for the crime in Brazil. The ministers will analyze whether the sentence meets formal requirements (if it was handed down by a competent authority abroad, if the defendant was summoned, if the decision does not offend Brazilian public order, among others).

Robinho was initially convicted in 2017, appealed and had his attempts exhausted in 2022, with a final judgment in Italy.

Presided over by the vice-president of the STJ, minister Og Fernandes, the trial will begin with oral arguments by the parties. Each party can present for up to 15 minutes. After that, Minister Francisco Falcão, rapporteur of the case, will present his vote. The other ministers vote in sequence, in order of seniority.

The Special Court is made up of the 15 oldest ministers. For the sentence to be approved, a simple majority vote is required – half plus one of the ministers. The president of the session only votes in the event of a tie.

There is the possibility of requesting a review, which happens when one of the ministers does not feel qualified to vote at the moment and asks for a period of time to analyze the process. In this case, the trial is postponed, with a deadline for resumption set at up to 60 days, extendable for another 30.

Robinho has always publicly denied the crime. The Italian police, however, recorded conversations between the former athlete and his friends in which he confirms the victim’s unconscious state at the time of the crime. “That’s why I’m laughing, I don’t care. The girl was extremely drunk, she doesn’t even know who I am,” said the former player.

The recordings were part of the material used by the Italian Public Ministry in the process that convicted the Brazilian of gang rape.
