The trial of the Italian government’s request for former football player Robinho to serve a sentence in Brazil should take place on the 20th by the STJ (Superior Court of Justice)

The case will be judged by the Special Court of the STJ, which brings together the 15 most senior ministers of the court.

Convicted of gang rape, the former player was sentenced to nine years in prison, but is free in Brazil, whose legislation prevents the extradition of native Brazilians.

In November, the Federal Public Prosecutor’s Office argued that the Milan Court’s request for approval of the sentence should be accepted. According to Deputy Attorney General Carlos Frederico Santos, “all legal and regulatory requirements for the continuation of criminal execution were met.”

Robinho, now 40 years old, was initially convicted in 2017, appealed and had his attempts exhausted in 2022, with a final judgment.

According to the investigation in Italy, the athlete and five other Brazilians committed group sexual violence against a woman of Albanian origin in a nightclub in Milan in 2013. He always denied the crime.

The STJ has not yet taken a position on the merits of the issue, that is, whether or not the former player should be arrested. He only denied the defense’s appeals about possible irregularities in the Italian procedure.

According to Minister Francisco Falcão, rapporteur of Italy’s request for approval, the former athlete was duly represented by a lawyer in the criminal proceedings and there is no reason to assume that there were irregularities.
