Rogério Caboclo recovers political rights with injunction – 01/18/2024 – Sport

The 6th Civil Court of Barra da Tijuca, in Rio de Janeiro, granted this Thursday (18) an injunction to suspend all penalties imposed by the Ethics Commission of the CBF (Brazilian Football Confederation) against Rogério Cabloco, former president of the entity.

Signed by judge Flavia de Almeida Viveiros de Castro, the decision allows Cabloco to recover his political sporting rights, which had been suspended following accusations of sexual and moral harassment against the manager.

According to the injunction, to which the Sheet had access, the judge agreed with the arguments of the top hat’s defense, according to which the CBF did not hear witnesses and did not allow cross-examination when defining the punishment at the Ethics Council.

Caboclo filed the request on December 15th. The case was being processed in secret, now raised by judge Flavia de Almeida.

Elected in 2018 to lead the CBF, the top hat was removed from his position in 2021, when he was the target of harassment allegations, which led the entity’s Ethics Council to suspend him for 21 months.

With this decision, he will be able to compete again for positions at the sports entity.

In a note, lawyers Luiz Paulo de Sequeira Junior and Thiago Marchi Martins, representatives of the top hat, state that “the decision given, still in the preliminary phase, is of utmost importance, since the accusations made against Rogério were the subject of three legal actions and all were terminated without any indication of guilt or imposition of penalties”.

They also add that, “as this administrative punishment – ​​now suspended – was the only one that still remained, the injunction granted began to shed light on all the arbitrariness committed against Rogério in the administrative procedure riddled with nullities that culminated in his dismissal”.

In November 2022, the court had closed the harassment allegations against Caboclo. First, a former director of the entity, who accused him of moral harassment, withdrew the complaint.

Then two other complaints appeared. One of them was filed on the initiative of the MP-RJ (Public Ministry of Rio de Janeiro) in July this year. The other had a request for habeas corpus approved by the TRF-2 (Federal Regional Court of the 2nd Region) by two votes to one.

In the case that led to his dismissal, recorded by a presidential employee who recorded foul statements made by the leader, Caboclo made an agreement with the MP. He did not admit guilt, but paid compensation of an undisclosed amount.
