In the 2022 campaign, TSE banned posts relating Lula and abortion

Although the Superior Electoral Court (TSE) banned advertisements and posts that said that Lula supported abortion in the 2022 elections, the PT government’s recent actions do not deny its support for the murder of babies in the womb.

A new technical note, published by the Ministry of Health this Wednesday (28), allows abortion for women pregnant up to nine months, if they claim they were raped and want to abort. The limitation for the procedure, which was previously 21 weeks and 6 days, no longer has this time limit, making it possible to carry out abortion, in cases where it is not punished in Brazil, up to 40 weeks of gestation.

Abortion is a crime in Brazil, not punished in cases of rape and risk to the woman’s life (article 128 of the Penal Code) or when the baby suffers from anencephaly, according to a 2012 decision by the Federal Supreme Court.

The decision to authorize abortion, in cases not punished by law, in any week of the administration, reinforces some of Lula’s previous statements on the subject, which were prohibited from being released in the 2022 elections by the TSE, as they were “out of context”.

One of the statements prohibited from being broadcast was made by Lula in April 2022, during an event at the Perseu Abramo Foundation. The PT member said: “And madam, she can have an abortion in Paris. Here in Brazil she doesn’t do it because it’s prohibited. When in fact it should be turned into a public health issue and everyone should have the right. This family agenda, the values agenda, is something long overdue”.

At the time of the election campaign, former president Jair Bolsonaro released an advertisement in which a speech by Mother Teresa of Calcutta was shown against the right of a mother to “murder her own child in her own womb”. After playing a speech by Lula, an announcer said: “Are you a Christian and do you intend to vote for Lula? Then you are not a Christian.” In October 2022, Minister Cármen Lúcia vetoed the showing of the propaganda (a similar video, posted by supporters, was also removed from social media) pointing out “gross adulteration” of the meaning of the PT member’s speeches.

“The statement [relativa ao aborto] does not correspond to true or proven data, and there is no proof that the candidate has declared, promised or presented a government project to promote the change of the law that deals with the issue of abortion”, said Cármen Lúcia, on October 14, 2022 , by banning any propaganda that showed Lula defending abortion.

In an editorial, published on October 17, 2022, the People’s Gazette showed that “if there is something that the PT is committed to, it is the legalization of abortion, which has been officially part of the party’s platforms since 2007.”
