Family of fire victim in ‘Ninho do Urubu’ will be compensated

The Rio Court ruled that the Clube de Regatas do Flamengo will have to pay compensation to the family of goalkeeper Christian Esmério Cândido, who died at the age of 15, as a result of the fire in the youth category’s accommodation at the George Helal Training Center, known as Ninho do Urubu, in Vargem Grande, west of Rio.

In the decision, judge André Aiex, from the 33rd Civil Court of the Capital of the Court of Justice of the State of Rio de Janeiro, defined that Flamengo has to pay R$ 1 million and 412 thousand to his father Cristiano Esmério de Oliveira, and the same amount to mother Andréia Pinto Cândido de Oliveira.

The judge also decided that the athlete’s brother, Cristiano Júnior Esmério de Oliveira, is entitled to compensation in the amount of R$120,000 as compensation for moral damage. In addition, parents will receive a pension equivalent to five minimum wages.

In the fire that occurred on February 8, 2019, ten players from the club’s academy died and three were injured. All were aged between 14 and 16 years old. The players were sleeping in the accommodation and were surprised by the fire that engulfed the facilities.

Judge André Aiex also defined that the pension to Christian’s father and mother must be paid until the year in which the athlete turns 45 or until the date of his parents’ death.

“Considering the specificities of a football player’s career, notably that of a goalkeeper, the payment set out above must be made by the defendant until the date on which the fatal victim would have turned 45 years of age, or until the date of death of their parents, the whichever comes first”, he decided.

The judge did not accept the request for compensation for the athlete’s uncle.

Christian’s family is the only one who will receive compensation through a court decision. The relatives of the other victims made an agreement directly with the club.

In a statement on the eve of the fifth anniversary of the tragedy, Flamengo reported that the only family that did not accept the agreement offered received a monthly pension paid by the club, regardless of legal proceedings.

“Flamengo remains open to reaching a partnership with them, whom they value very much”, he pointed out that day.

The Agência Brasil report asked for a statement from Flamengo about the court’s decision to pay compensation to goalkeeper Christian’s family, but until the publication of this article they had not received a response.
