Defense asks the STF to suspend Robinho’s arrest order – 03/21/2024 – Sports

The defense of former player Robson de Souza, Robinho, filed a request for habeas corpus with the STF (Supreme Federal Court) to suspend the immediate arrest order until the court judges the appeals against the decision of the STJ (Superior Court of Justice ).

The STJ validated, this Wednesday (20), the Italian sentence that sentenced former player Robson de Souza, known as Robinho, to prison for the crime of gang rape, in an initially closed regime.

The court also ordered that the Federal Court in Santos be sent to the Court to immediately comply with the sentence.

In the request for habeas corpus, Robinho’s defense, led by lawyer José Eduardo Rangel de Alckmin, states that there is “great legal plausibility” that the STF will reverse the STJ’s decision.

In the lawyers’ view, the validation of the Italian sentence “is completely contrary to the Constitution of the Republic”.

“The decision made [pelo STJ] is subject to appeals, such as embargoes and extraordinary appeals, and it is clear that the issue involves debate on relevant constitutional issues, such as the issue of the non-extradition possibility of native Brazilian citizens”, says the defense.

These arguments are used by lawyers because the Supreme Court is responsible for discussing issues related to the Constitution.

As of Thursday morning (21), the habeas corpus request had not yet been distributed to a court reporter.
