Former football player Daniel Alves, convicted of rape in Spain, paid bail of €1 million, the equivalent of R$5.5 million, this Monday (25). His release from prison is expected in the next few hours.

Alves has been imprisoned in the Brians 2 penitentiary center, in the metropolitan region of Barcelona, ​​for 14 months, since January 20, 2023. That morning, he presented himself to the police following a complaint from a 23-year-old girl and was taken to prison.

The rape took place on December 30, 2022, at the Sutton Barcelona nightclub. According to the complaint, Alves forced her to have sex in the bathroom of the VIP area. On February 22 of this year, the Brazilian was sentenced to 4 and a half years in prison, but the final sentence still depends on the parties exhausting their appeals.

Thus, on the 19th, Alves’ defense lawyer, Inés Guardiola, asked for the former player’s provisional release for the fifth time and was finally successful.

The order of the court that accepted the request informed that imprisonment before the final sentence “cannot, under any circumstances, anticipate the effects of a hypothetical sentence that may be imposed”. It is still unclear how Alves managed to raise the bail money, as his assets in Brazil are blocked due to a lawsuit filed by his ex-wife. The bail payment was confirmed by the Superior Court of Justice of Catalonia at around 11:30 am (7:30 am in Brasília).

As stated by the Sheet on Wednesday, Guardiola was seeking to coordinate the payment of bail with the receipt of a refund from the Spanish federal revenue, here called Finance, in the amount of €1.2 million (R$6.5 million). Alves won this case from the Treasury about a month ago, but, until this Thursday, he had not received the money.

The lawyer ruled out the idea of ​​asking the father of another player, Neymar, for help. Last year, to try to reduce the sentence if the Brazilian was convicted, Neymar’s father actually paid, at Alves’ request, 150 thousand euros (R$815 thousand) as a “mitigation to repair the damage caused”.

But this time, after the Spanish newspaper La Vanguardia published that the businessman would do the same now, information repeated worldwide, he went public to deny that he would make this new loan.

Alves’ freedom was conditioned on paying bail, handing over the defendant’s two passports (Spanish and Brazilian), being prohibited from leaving Spanish territory, appearing at the Barcelona Provincial Court weekly and when summoned, not approaching the complainant at a distance of less than one kilometer from her home, her place of work and any other place she frequents and not attempt to communicate with her by any means.

According to magistrate Ignacio González Vega, a specialist in the Spanish Penal Code, he told Folha last Wednesday (20), the bail must be returned to the player when he is arrested again. “Bail exists to ensure that the defendant will be available to the court,” he explained.
