“You were my biggest disappointment”

After blocking the amount of BRL 1,720,897.99 from Willian Bigode and partners in a lawsuit filed by Mayke, the lawyer for the winger and Gustavo Scarpa added prints of conversations between his client and the Athletico striker, between 2021 and 2022. The conversations show how the midfielder’s interest in making applications in cryptocurrencies with XLand and the athlete’s disappointment with his friend after the frustrated attempts to recover the invested amounts.

The dialogues make up the set of evidence that Scarpa’s defense is attaching to the file to demonstrate the involvement of Willian’s company, WLJCwith investment fraud that led to a default of BRL 6.3 million.

On February 10, 2022, there is a conversation between Scarpa and Willian via WhatsApp, in which the Nottingham Forest player shows interest in meeting one of XLand’s partners. Willian replies that “Gabriel from XLand is in Dubai, they are opening an office for operations there (emojis of palms and green check).” Scarpa, then, says “Glories, amen. There, yes emmmm. It’s not really a pyramid (laughter emojis). Review.” The Athletico striker tries to justify. “Hahahah to get to Dubai it has to be, in Brazil it’s cool (thumbs up and laughter emojis)”.

On the same day, after Willian sent a graph that would be “XLand’s operating history”, Scarpa is delighted with the percentages. “Ahhh, papaiii, almost 50% in the year, so XP will lose me.” Willian responds to his colleague and says that the Nottingam Forest player should diversify his investments. “Noooooooooo. Salomão already said, diversify, never leave everything in one place (flashing emoji) hehhe.”

In the dialogue, Scarpa also signals that he would like to build a R$ 2.5 million public skate park, in a social project, with the return on investments and suggests placing the XLand brand on the site. “Exactly. The money is for building the runway but it will be public, there is a social project involved. Yes, we can put the XLand brand on the runway.”

On December 7, 2022, Scarpa also complains about not having received an apology from Willian. “What makes me most sad about all this is that so far there has been no apology from you or Camila (Willian’s partner at WLJC). You worried now that yours is on the line too, but zero concern for me Disappointing. From Gabriel and Jean (XLand partners) I don’t even care, because they are bandits. You mainly bibi (nickname used by Scarpa to refer to Willian), I’m not even a friend of Camila, just a professional. I thought I would defend with everything possible, in every way. You did nothing for me in this matter, in helping. I speak from the heart, I am very sad”.

Willian says he is also sad about the situation. “Scarpa, my sadness is also very great. If you thought that, and you’re acting like that, I can’t control you. I know who I am.”

Scarpa was irritated by his former clubmate’s response. “Is this serious? Really? The fact that you know who you are exempts you from asking for forgiveness?? Does it exempt you from worrying about my situation as a friend and client? Alright bro. Understood.”

On December 15, 2022, Scarpa sends a new message to Willian. “You were my biggest disappointment in life. Doing all that you are doing and did never crossed my mind. You would be the last or one of the last people I imagined that one day would have the courage to do this. You failed me like man, but mainly as a friend. Well, my father warned me.”

NEW STEPS

Willian’s defense, led by lawyer Bruno Santana, asked the judge to organize Gustavo Scarpa’s action, which already has more than 900 pages. The request for calling the order to order is intended to prevent errors from occurring in the judgment and from incurring or generating nullities.

“It is necessary to make an arduous cognitive effort in an attempt to decipher the legal logic, the nexus, and the claim of the author in the aforementioned manifestation that due to legal ignorance or lack of knowledge of procedural rules confuses any reader who proceeds to read the respective petition”, says an excerpt of the petition.

“It is clear that the plaintiff’s lawyer has acted with great inattention, showing possible ignorance of the fact, otherwise the only interpretation that remains for us is that he has been trying to disturb the records of this process, polluting it too much, since such behavior in addition to polluting the case with procedurally disconnected manifestations and decisions on other materially useless demands, it did not even deign to comply with the judicial order and, as a result of how much aired it ends up causing an embarrassment in the case file, which only disrupts the procedural order”, concludes the lawyer from William.

UNDERSTAND THE CASE

The lawsuit filed by Scarpa and Mayke points out that Willian and his partner Camila Moreira de Biasi suggested investing in XLand, which would offer a return of 2% to 5% on the amount invested. Scarpa invested BRL 6.3 million, while Mayke and his wife, Rayanne de Almeida, invested BRL 4,583,789.31.

Problems with XLand began in mid-2022, when Palmeiras players tried to rescue profitability, but were unsuccessful after XLand’s follow-up negatives and postponements. Later, they tried to break the contract, but they also did not receive the amount due.

After successive contacts with the partners of XLand, Jean do Carmo Ribeiro and Gabriel de Souza Nascimento, with Willian and Camila and a financial management coach, Marçal Siqueira, who had a partnership with the company from Acre, Scarpa and Mayke sought out their lawyers and registered a incident report. Since then, the process has been running in the São Paulo Courts, with no decisions yet on the guilt of the defendants.
