In a decision with nods to President Lula (PT), with whom he has worn himself out in recent years, STF (Supreme Federal Court) Minister Dias Toffoli said that the PT’s arrest was a frame-up and the “true serpent’s egg of attacks on democracy “.

According to him, Lula’s imprisonment “could even be called one of the biggest miscarriages of justice in the country’s history”, but “but, in fact, it was much worse”.

Toffoli determined this Wednesday (6th) that the evidence arising from Odebrecht’s leniency agreements and also from the Drousys and MyWebDay systems —respectively for internal communication and accounting and control of payments of undue advantages— are useless in any scope or degree of jurisdiction.

“It was a setup resulting from a project of power by certain public agents in their objective of conquering the State by apparently legal means, but with contra legem methods and actions. [a lei]”, Toffoli said.

“I say without fear of making mistakes, it was the true egg of the serpent of attacks on democracy and institutions that were already announced in actions and voices of these agents against the institutions and the STF itself. in collusion to reach institutions, authorities, companies and specific targets”, said the minister.

Lula’s representative in the action is Valeska Zanin Martins, wife of minister Cristiano Zanin, who advocated for the president in the Lava Jato processes.

Toffoli was appointed to the Supreme by Lula in 2009, when he was attorney general of the Union, and has always been a trusted name for the PT.

In recent years, however, he has maintained a close relationship with former President Jair Bolsonaro (PT) and the Bolsonarist base. He even classified the 1964 military coup as a “movement”.

Toffoli’s main problem with Lula, however, happened when he prevented the PT supporter from going to his brother’s wake while he was imprisoned in Curitiba.
