Toffoli cancels tests against Tacla Duran – 06/15/2023 – Mônica Bergamo

The Minister of the Federal Supreme Court (STF) Dias Toffoli annulled all evidence of criminal actions against Rodrigo Tacla Duran that ran on the 13^The Federal Court of Curitiba.

With that, the STF paves the way for the blocking of actions against him.

The lawyer must also, as a result, be released from the equivalent processes that he suffers in Spain on the basis of this alleged evidence. With that, he will be able to return from the European country to Brazil.

Tacla Duran is invited by the Chamber of Deputies to clarify allegations of extortion that he says he suffered in Lava Jato, and that have the former judge and now senator Sergio Moro (União Brasil-PR) as a target.

According to Toffoli, the actions against Tacla Duran used evidence from Odebrecht’s leniency agreement that had already been considered “useless” by the STF.

In this Thursday’s decision (15), the magistrate reaffirms “the unworthiness, as regards the applicant, of the evidence obtained from the Drousys and MyWebDay B systems [de contabilidade paralela] used in the leniency agreement entered into by Odebrecht”.

Actions against Tacla Duran had already been suspended in March by then Minister Ricardo Lewandowski.

He also used the argument that the STF itself, in judgment of the 2^The Class, had considered the evidence of Odebrecht’s delation “unappealably compromised” by “incurable vices”.

Copies of data taken from the contractor’s systems would even have been tampered with. Proceedings involving President Lula and other defendants had therefore already been terminated.

A month after Lewandowski’s decision, however, the judge Marcelo Malucelli, from the Federal Regional Court of the 4th^The Region (TRF-4), reinstated an arrest warrant against Tacla Duran, who now lives in Spain.

Malucelli is the father of João Malucelli, boyfriend of Moro’s daughter and partner of his wife, federal deputy Rosângela Moro (União Brasil-SP), in a law firm.

Faced with what he considered disobedience to the STF, Minister Toffoli reaffirmed the suspension and determined that the entirety of the actions be sent to the STF. And now he has decided that the evidence contained therein against Duran must be definitively disregarded.

Toffoli had already granted preventive habeas corpus for Tacla Duran to return to Brazil to testify in the Chamber without being arrested.

The lawyer, however, sent a letter to the STF saying he still fears returning to the country and having his rights violated, especially because of the lawsuits that continue to be processed in Spain based on the alleged Brazilian evidence, now annulled.

Tacla Duran’s accusations against Lava Jato were revealed by the column in 2017.

The lawyer provided services to the contractor Odebrecht and was being investigated by Operation Lava Jato for money laundering and formation of a criminal organization.

According to Duran, in the midst of negotiations for a collaboration agreement with the Curitiba task force, he would have been approached by lawyer Carlos Zucolotto, a friend and best man at Moro’s wedding.

According to what he said, the compadre of the then judge made him a proposal to pay US$ 5 million through slush funds to obtain a softening of the sentence and a reduction in the fines that he should have paid to the Court.

If he agreed with the extortion, the lawyer could serve house arrest and pay less than half the fines.

Tacla Duran said he refused to make the deal and left Brazil. Today, the lawyer lives in Spain.

Moro and Zucolotto have always denied the allegations. According to the former judge, Tacla Duran is a criminal who has no credibility.

Tacla Duran was invited by the Chamber’s Administration and Public Service Commission to provide clarification on the allegations he has been making against Moro’s friend and compadre.
