The parliamentarian presents PL on the World Awareness Day on Violence against the Elderly

Manaus (AM) – Federal deputy Saullo Vianna (União-AM) presented Bill (PL) 2521/2023, which provides for the urgent and immediate application of protective measures for the elderly in cases of violation of their rights, recognized in the aforementioned Statute of the Elderly Person. The idea is to prioritize physical and mental protection, as well as maintaining the well-being of the elderly person.

“My bill aims to match, in terms of speed of the procedural rite and application of penalties, compliance with the Statute with the Maria da Penha Law, as that which guarantees the immediate removal of the author of the aggression that, in more of 87% of cases, it occurs in the family environment, among other measures that seek to safeguard the life of the elderly”

explains Saullo Vianna.

According to the text of the Bill, the authorities are obliged, immediately, to adopt procedures such as listening to the victim, collecting all the evidence necessary to clarify the fact and sending, within 48 hours, a file to the judge with the request for the granting of urgent protective measures.

“In addition, once the risk to the physical or psychological integrity of the elderly person has been verified, in a situation of domestic violence, the aggressor will be immediately removed from the place where the victim lives, among other protective measures. This is because the elderly, who already suffer the emotional upheaval of having to narrate the violence suffered by a family member, still have to remain in the same environment as their aggressor due to this gap in the legislation”

Violence – Data from the National Violence Panel of the Ministry of Human Rights reveal that violence against the elderly is the second highest in the country, second only to violence against children and adolescents. After the Covid-19 pandemic, according to the Ministry’s ombudsman, reports of violations against the elderly increased by 100%. From 37,490 cases registered in 2018, the total number of complaints, in 2022, jumped to 80,658.
