TCM auditors ask Nunes to make a technical choice for vacancy – 02/27/2023 – Panel

In a text sent to the Panel, the Association of External Control Auditors of the Court of Auditors of the Municipality of São Paulo (AudTCMSP) asks the mayor of São Paulo, Ricardo Nunes (MDB), to qualify the choice he will make of a new director for the cut.

As the column showed, Nunes has a list of four names to fill the vacancy that will open with the retirement of Maurício Faria, in June. Fabrício Cobra Arbex (Secretary of the Civil House), Marcela Arruda (Management), Ricardo Torres (Finance) and Ricardo Menezes (legal director of SP Obras) are the favorites of the emedebista.

In response, the auditors claim that those appointed to the positions of counselors and ministers of audit courts, in most cases chosen mainly for political reasons, may be inclined to favor personal interests or those of a group, losing sight of the priority of protect the public interest.

They say, then, that more than complying with the legislation and proposing a name that includes technical and professional requirements, Nunes could broaden the debate on the adequate profile to compose the TCM-SP, inviting universities and entities in the control area to deal with the topic and support your decision.

“The body of TCM-SP auditors, for example, has extremely qualified names, which could be considered in this process [de escolha de conselheiros]”, states the text.

The auditors also draw attention to the fact that the TCM-SP is the only one in the country that does not have the careers of prosecutor of the Public Ministry of Accounts and substitute counselor, which, according to them, would provide technical names for a more balanced composition of the collegiate.

Finally, they stress that the TCM-SP has never had a senior woman on the governing body in its more than 50 years of existence, a fact that Nunes should take into account in his decision.

“The current process of choosing the leaders of the Courts of Auditors needs to be rethought in the legislative sphere, but nothing prevents Mayor Ricardo Nunes from qualifying his choice on his own, allowing for a more republican and impersonal nomination”, concludes the text.
