Governor Tarcísio de Freitas (Republicans) wants to pay reserve military police officers who work in civic-military schools more than he pays teachers in the São Paulo state network.

The government is betting on the approval of the project and wants to open 50 civic-military schools next year and another 50 in 2026. “We understand that it is something that adds civics, Brazilianness, discipline, it is of interest to parents. It will contribute to students and nothing interferes with the school’s pedagogical routine”, said the governor this Thursday.

In a statement, the Department of Education denied that the amount it will pay to police officers is greater than the teaching salary in the state. “The average salary paid to teachers in the network is R$6,057, according to a calculation made from the Transparency Portal”, says the ministry.

The amount paid to security officers, however, will be added to the salaries they already receive from the police reserve.

For comparison, the average salary of São Paulo PM soldiers was R$6,362.28 in March last year. The number is from the X-Ray of the Public Security Forces in Brazil, a survey released in February by the Brazilian Public Security Forum.

Tarcísio started to promise the model to oppose President Luiz Inácio Lula da Silva (PT), when the federal government decided to end the national program to promote civic-military schools created by former president Jair Bolsonaro (PL).

According to Tarcísio’s proposal, reserve PMs will work in these schools to take care of “school security” and develop “extracurricular activities of a civic-military nature”. To do this, they will receive a supplement of R$301.70 for each 8-hour day — with the possibility of working up to 40 hours per week.

The total amount that police officers can receive just as a supplement, as they will still continue to receive reserve pay, is 13% higher than the R$5,300 defined as the minimum salary for state school teachers working 40 hours a week.

According to the text, police officers participating in the program will be selected through a selection process and will act as “task providers” for a maximum period of five years.

The project proposes that the supplement be increased by up to 50% for reserve military police officers who will act as coordinators of the program — in other words, the additional could exceed R$9,000.

Payment of this supplement will be made by the SSP (Public Security Secretariat), which must receive the resources from the Education Secretariat. The project does not provide an estimate of how many police officers will work in schools, nor the annual cost of the program, but the government is working with the possibility of 1 police officer for every 90 students (equivalent to three classrooms) or 120 students (equivalent to four classrooms). .

The text only says that the number of reserve police officers who will work in each unit will be defined by the Secretary of Education, Renato Feder. He also highlights that agents “will not be considered, for any purposes, as basic education professionals”.

Despite working within schools and the management of the unit remaining under the responsibility of the teaching staff, the selected agents will be subordinate to a group of coordinators, also made up of reserve PMs, who will be allocated to the Department of Education.

A Sheet deputy Lieutenant Coimbra (PL), one of the project’s organizers, defended the remuneration offered to retired police officers and Fire Department agents as a way of attracting them to services in schools. “If you enter a different value [abaixo] What does the administrative service pay? According to the deputy, there is plenty of supply for these retired officers in administrative police roles. “In administrative service, military personnel will continue to receive pay in accordance with their career in the police,” said Coimbra.

The soldiers will be unarmed, dressed in school uniforms and will perform administrative and organizational functions. They will be responsible for welcoming the students, organizing them for the playing of the national anthem and the raising of the flag, in addition to monitoring the moment they leave the school.

“The military will not enter the classroom, with the exception of the values ​​project, where he will teach civics, citizenship, national symbols. Everything will still be regulated”, said Coimbra, which has an agreement with Tarcísio’s base in Alesp to take over the project report.

Coimbra was the author of a law that dealt with the promotion of the civic-military model, but the Court of Justice annulled the text because it understood that the Legislative Branch had no legitimacy — only the Executive Branch. To avoid new judicial interference, it was the Tarcísio administration that presented the bill this time.

Extracurricular activities, such as the values ​​project mentioned by the deputy, will be defined by the Department of Education in conjunction with the Public Security department.

According to the government’s proposal, the implementation of the civic-military model must consider the rates of school performance, flow and social vulnerability. “We will select some schools by social profile, trying to focus on areas in which we are vulnerable”, said Tarcísio.

Institutions in indigenous and quilombola areas should not be included, as well as schools with night classes and shared management.

The government is committed to promoting public consultation with the community when selecting the school. “The quorum for approval of the proposal submitted for public consultation will be a majority of votes, with the absolute majority of members of the school community present”, says an excerpt from the bill.

The sufficient quorum, according to the text, will be a majority of votes. In case of insufficient quorum, the proposal may be resubmitted three times within the academic year.

Termination of the federal program

In July last year, the Lula government began the process of completely abolishing the federal program to promote civic-military schools, a Bolsonaro banner.

The PT Ministry of Education, commanded by Camilo Santana, carried out a legal study on the topic which found that the model violates the Constitution and the guidelines of Brazilian education.

Article 61 of the LDB, which defines the necessary qualifications for basic school education professionals, says that they must be qualified to teach. A requirement that is not made to military personnel who work in schools.

The Military Statute also does not provide, in any of its provisions, that dedicated activities to public education policies are part of their responsibilities.

The MEC study also warned that the allocation of military personnel in school functions is “a flagrant deviation from its purpose as a State structure”, in addition to drawing attention to the salaries paid to officers, which are much higher than the amounts received by teachers and even even school principals.

“The robust investments to maintain retired military personnel in public elementary and secondary schools in advisory and support activities seem to mock the scarcity of resources that education networks are able to mobilize to pay their own staff,” says the study.

Despite the understanding that the model violates the country’s educational legislation, the Lula government did not prohibit or regulate the presence of military personnel in schools. At the time, experts pointed out that the PT administration’s decision could boost the Bolsonarist flag of militarization of basic education.
