The Second Panel of the Federal Supreme Court (STF) decided this Tuesday (9), unanimously, to return the passport to engineer Sérgio Souza Boccaletti, convicted in open actions during Operation Lava Jato. Boccaletti worked at Petrobras and was responsible for the crimes of corruption and money laundering for the payment of bribes in the works of the Abreu e Lima Refinery, in Pernambuco.

The ministers’ decision came in the judgment of motions for clarification in a habeas corpus requested by Boccaletti’s defense. According to the vote by Minister Gilmar Mendes, which was followed by Nunes Marques and Edson Fachin, maintaining restrictions on the use of passports and travel abroad is “disproportionate and incompatible with the stage of the process, with the behavior of the parties and with fully operational possibilities for international criminal cooperation”.

Fachin was the rapporteur for the case and had initially declared himself against the request. However, after Mendes’ vote, he decided to review his position to accept the repeal of the precautionary measure.

Nunes Marques recorded in his vote that the measure has lasted for more than four years.
