Silvia Waiãpi signs project to overturn President Lula’s gun decree – News of Brazil

Federal deputy Silvia Waiãpi (PL-AP) joined 52 other congressmen and signed a draft legislative decree to overturn the decree on weapons issued by the government of President Luiz Inácio Lula da Silva, published on Friday (21), by the Ministry of Justice and Public Security. The project was presented by Bolsonarist delegate Paulo Bilynskyj (PL-SP) and was filed on Saturday (22), gathering 53 signatures from opposition parliamentarians.

In the text, the group of congressmen calls for the suspension of the decree of the current government, on the grounds that “such a measure exceeds the regulatory power, since it violates […] the Disarmament Statute”. For them, the transfer of the registration of firearms for restricted use to the Federal Police, as proposed in the presidential decree, “raises concerns regarding compliance with current legislation”, according to the argument presented in the justification for the article.

In justifying the project, the federal deputies claim that the new decree on weapons by the Lula government “violates” two articles of the Disarmament Statute (Law 10,826 of 2003). Article 3 of the law makes it mandatory “the registration of a firearm with the competent body”, while the sole paragraph, “firearms for restricted use will be registered with the Army Command, in the form of the regulation of this Law”.

For congressmen, these articles clearly establish “the competence of the Army Command to carry out the registration of these weapons, making the measure a potential violation of the law”.
