Rosangela Moro: Electoral Public Ministry is called – 03/08/2024 – Mônica Bergamo

Businesswoman Roberta Moreira Luchsinger sued the São Paulo Regional Electoral Attorney’s Office against federal deputy Rosangela Moro (União-SP), who transferred her electoral title back to Paraná after being elected by the state of São Paulo.

The change was revealed by the column on Thursday (7) and represents a turnaround in the political scenario in Paraná and even Brazil. Now, Rosangela is a concrete alternative to running for the Senate if her husband, now Senator Sergio Moro (União-PR), is revoked by the Electoral Court.

Luchsinger, who is a member of the PT and was responsible for a criminal report that accused Moro of fraud in his attempt to change his electoral domicile to São Paulo in 2022, accuses the deputy of “playing with electoral legislation” and “mocking the electorate”.

The representation is signed by lawyer Maíra Recchia, from the firm Araujo Recchia Santos Sociedade de Advogados, and presents an unprecedented legal thesis: that Rosangela had committed domestic infidelity by abandoning the São Paulo electorate that elected her to the Chamber of Deputies.

“It is a fact that when this domestic bond is broken, the relations and reciprocal interests between the elected and the electorate disappear”, states the document submitted to the Public Electoral Ministry by Recchia, who is also president of the Electoral Observatory of the OAB (Ordem dos Advogados) of São Paulo .

“By being elected by a state and now changing her electoral domicile, it is clear that she expressly renounced the representation of the people who chose her, removed one of the eligibility conditions and must now lose her mandate”, continues the representation.

When contacted by the column, the federal deputy did not respond until the publication of this text.

Supporters of the couple claim that Rosangela Moro transferred the title to Paraná for logistical reasons, as her husband was elected by the state and remains domiciled in Curitiba. They also say they are certain that Moro will not be impeached, and that therefore she will not be a candidate to replace him.

Luchsinger’s defense, however, states that the Constitution provides that being domiciled in the same constituency in which the candidate contests the elections is one of the fundamental conditions for his eligibility — and argues that this condition be maintained until the end of the term.

“Currently, the represented woman’s husband faces an electoral judicial investigation action for abuse of political and economic power and improper use of social media outlets, which could culminate in the revocation of his mandate as senator, which denotes the legal chicanery style modus operandi -family”, says the businesswoman to the Regional Electoral Attorney’s Office.

Luchsinger asks that Rosangela Moro be the target of an investigation that investigates the alleged practice of electoral malpractice and the possible loss of mandate generated by the change.

“The facts for which an investigation is required are serious and undermine not only the candidates harmed in the electoral process, but mainly the democratic rule of law”, says the businesswoman.

Moro’s trial is scheduled for April 1st at the Regional Electoral Court of Paraná (TRE-PR). The former judge is the target of two actions, from Jair Bolsonaro’s PL and the Brazilian Federation of Hope, which brings together PT, PC do B and PV, parties at the base of Lula’s government.

The parties accuse him of abuse of economic power, slush funds and improper use of social media in the 2022 pre-campaign. He denies the accusations.
