ES deputy released after assembly overturns Moraes’ order

Imprisoned since the night of February 28, 2024 by order of the minister of the Federal Supreme Court (STF), Alexandre de Moraes, deputy Capitão Assumção (PL-ES) was released this Thursday (7) after the Legislative Assembly of Espírito Santo (Ales) overturn the minister’s decision.

The arrest of the deputy for alleged non-compliance with precautionary measures was requested to the STF by the Public Ministry of Espírito Santo (MP-ES)

On Wednesday (6), deputies voted in favor of the opinion produced by a special commission that requested the revocation of the parliamentarian’s arrest. To be approved, the opinion needed at least 16 votes. In total, 24 deputies approved the opinion.

The result of the vote was sent to the STF on the same day and minister Alexandre de Moraes accepted the resolution.

Assumção is accused of involvement in an alleged scheme to disseminate fake news and attacks on STF ministers. The deputy is also accused of participating in “anti-democratic acts” in his state.

The parliamentarian had been monitored by an electronic ankle bracelet since December 2022, after a Federal Police operation launched in several states, including Espírito Santo.

Even released, Assumção will have to hand over his passport and is prohibited from leaving the state. The parliamentarian will also remain prevented from publishing on social media and will continue to have restrictions on carrying firearms.

As reported by People’s Gazettethe deputy’s arrest was determined by Moraes because of posts on the social network TikTok.

Moraes justified the decision based on posts made by the parliamentarian that had a “clear intention of coercing and preventing the exercise of constituted powers, with a flagrant affront to the maintenance of the Democratic Rule of Law”.

The judge highlighted that Capitão Assumção’s publications constituted a violation of the court decision that prohibited him from speaking out on social media.
