Robinho may move to the semi-open regime in 2027 – 03/22/2024 – Sport

Arrested on Thursday night (21) in Santos by the Federal Police to begin serving a nine-year prison sentence for rape in Italy, Robson de Souza, 40, known as Robinho, could move to the semi-open regime in mid-2027 .

According to Rafael Paiva, criminal lawyer and specialist in domestic violence, according to the penal code, the former player must remain in prison for at least 40% of the sentence, which corresponds to around 3.6 years.

“After this period, he has the right to go to semi-open prison, as long as he has good behavior and obtains a recommendation from the prison director”, says Paiva.

He adds that, initially, those accused of sexual crimes are usually isolated in a cell, or with other prisoners who have committed similar crimes, in order to guarantee their safety. “It may be that in the future this will change and he will go to a common cell”, says the specialist.

Criminal lawyer and master in economic criminal law from FGV (Fundação Getulio Vargas), Maria Tereza Grassi Novaes says that the former player has permission to receive visits from lawyers at any time at the Tremembé prison, where he arrived in the early hours of this morning. Friday (22).

Tremembé is known as the prison of celebrities. The place is where convicts are sent who, because they have some type of fame (either because they are a public figure or because the crime had great repercussions), are at risk in common penitentiaries. Alexandre Nardoni, Cristian Cravinhos, Gil Rugai, Lindenberg Alves, Mizael Bispo de Souza and Guilherme Longo, as well as doctor Roger Abdelmassih, have passed or still are there.

Former Santos player Edinho, Pelé’s son, was also imprisoned there when he served time for money laundering.

“The lawyer has free access to the penitentiary to talk to his client during office hours,” says Novaes, adding that visits from family members will depend on the bureaucratic rites of the penitentiary itself.

Friends and family must be registered among authorized visitors, a process whose deadline varies depending on the prison and the prisoner involved. “I’ve seen cases that took a month to register, others took a week”, says the lawyer.

She also says that the possibility of a reversal in the STF (Supreme Federal Court) is remote. “I see a review of Robinho’s arrest as unlikely,” she says.

According to the investigation by the Italian Public Prosecutor’s Office, Robinho and five other friends committed group sexual violence against the victim, who was drunk by them and, unconscious, taken to the establishment’s dressing room, where she was raped several times.

The accusation was based on the victim’s testimony and telephone conversations intercepted with authorization from the Italian Court, included as evidence in the process.

Despite having always publicly denied the crime, the former athlete was recorded by the Italian police speaking to friends. In conversations, he confirms the victim’s unconscious state. “That’s why I’m laughing, I don’t care. The girl was extremely drunk, she doesn’t even know who I am,” said the former player.

The recordings were part of the material used by the Italian Public Ministry in the process that convicted the Brazilian of gang rape.
