PV asks the STF to prohibit Zema from releasing registration without proof of vaccination

The Green Party (PV) asked the Federal Supreme Court (STF) to prohibit the government of Minas Gerais from exempting the presentation of proof of vaccination for enrollment in public schools. The action was presented after the governor, Romeu Zema (Novo), stated that “in Minas every student, regardless of whether they have been vaccinated or not, will have access to schools”.

The party filed an Allegation of Non-compliance with Fundamental Precepts (ADPF 1127), which will be reported by Minister Dias Toffoli. According to the STF, the PV argued that the refusal to implement the National Immunization Plan (PNI) has no legal basis and contradicts federal guidance that expanded the immunization plan against Covid-19.

The PV also highlighted that waiving the vaccination card could leave children exposed to a range of infectious diseases in schools, in addition to Covid. The party asked the STF to establish an interpretation of State Law 20,018/2012, which limits the obligation to present proof for children up to 10 years old, determining that state and municipal schools can charge for an updated vaccination card in all phases of education. .

Last week, Zema reaffirmed to the STF his position against the mandatory presentation of proof of immunization. He is also the target of a lawsuit filed by Psol, based on the same statement that led PV to sue the Court. The rapporteur of the action filed by Psol is minister Alexandre de Moraes, who requested a statement from the governor.

In the response sent to Moraes, on February 19, Zema said that the failure to present the vaccination card never prevented the exercise of “the full right of access to education”, although the document is requested at the time of registration as a form of awareness.
