Associations and representatives of state attorneys have been pressuring parliamentarians of the Constitution and Justice Commission of the Chamber not to consider a proposed amendment that includes civil servants in the process of electing the triple list of the State Public Prosecutors and the Federal District.
The original text, from 2003, deals only with the election process of the Attorney General of the Public Ministries of the States and the Federal District. The PEC says that they will be elected by career members. It was attached, among other proposals, one that extends direct voting to effective public servants for the formation of the triple list.
On June 30, the rapporteur, Deputy Rubens Pereira Júnior (PT-MA), presented an opinion for the admissibility of the text.
If approved, the amendment goes to a special committee. “The CCJ is the committee that discusses the admissibility of proposals, it does not discuss the merits. And the text does not violate the Constitution, which is why the disproportionate reaction is strange to us. [dos procuradores estaduais]”, says Alberto Ledur, coordinator of legislative affairs at Fenamp (National Federation of Workers of State Public Prosecutions). He says that the inclusion of civil servants will make the process more plural.
In response, Manoel Murrieta, president of Conamp (National Association of Members of the Public Ministry), states that members of the Public Ministry and public servants are subject to different legal regimes.
“Members have stability and lifetime, supporting their independence, in contrast to servants who fit into different normative systems”, he says.
He also states that the two groups have different functions and, while members carry out core activities directly related to the defense of public interests, civil servants are responsible for secondary activities that support the functioning of the MP.
