Law that expands punishments was published this Monday in the Official Gazette

Brazilian legislation that deals with the protection of children and adolescents against violence was reinforced this Monday (15), with the publication in Official Diary of the Union of Law 14,811/2024. The measure modifies the Penal Code, the Heinous Crimes Law and the Child and Adolescent Statute and makes penalties for crimes against this population more stringent.

One of the changes increases the punishment for the crime of homicide against children under 14 in educational institutions by two thirds. The text also establishes the requirement for criminal record certificates for all employees who work in places where activities with children and adolescents are carried out.

Another amendment establishes the penalty of five years in prison for those responsible for a community or virtual network, where suicide or self-mutilation of a minor under 18 years of age or a person with reduced resistance capacity is induced. This type of practice, as well as kidnapping, false imprisonment and trafficking of children and adolescents, was classified as a heinous crime.

The law also describes the crimes of bullying It is cyberbullying, defining a sentence of two to four years in prison for cases committed in a digital environment that do not represent a serious crime. Those responsible for transmitting or displaying pornographic content involving children and adolescents will also be penalized, in the same way as producers of this type of content, with imprisonment for four to eight years, in addition to the imposition of a fine.

The text also establishes a penalty of two to four years in prison for the crime of intentionally not reporting the disappearance of a child or adolescent. The changes take effect immediately and come into force with the publication of the law.
