Nunes’ delay in appointing a director hinders TCM – 06/13/2023 – Panel

The delay by the mayor of São Paulo, Ricardo Nunes (MDB), in nominating an interim counselor for the Municipal Audit Court has created obstacles to the operation of the capital’s audit court.

TCM members point out, for example, that processes related to the health area in São Paulo had Maurício Faria, a councilor who retired on May 30, as rapporteur. Since then, Nunes has not presented the name of an interim person for the vacancy, nor has he chosen his nominee to definitively assume the post.

As a result, lawsuits related to the lack of medication in basic health units (UBSs) are not forwarded, for example. In this case, an interim counselor could send an alert to the Municipal Health Department or determine the presentation of a plan to solve the supply problems.

On May 29, the TCM sent Nunes a list of 10 possible names to temporarily fill the vacancy and prevent the court’s workflow from being interrupted, but the representative did not send a response.

This Wednesday (14th), the deadline for the mayor to indicate the name of the person he wants to permanently occupy the position left by Faria. However, this indication needs to be endorsed by the City Council, which can drag on for months — a period during which an interim must perform the function.

Nunes’ favorite names are Marcela Arruda, secretary of Management, and Ricardo Torres, of Finance. However, Milton Leite (União Brasil), president of the Chamber, says that they closed an agreement in 2020 that he would choose the new councilor, but the mayor denies the existence of the agreement and claims that the choice will be exclusively his.

Leite’s favorite name is that of his son, state deputy Milton Leite Filho (União Brasil-SP).
