Paulo Gonet, appointed by President Luiz Inácio Lula da Silva (PT) to take over the Attorney General’s Office of the Republic (PGR), said this Wednesday (13), during a hearing in the Senate, that “freedom of expression is not full and must be modulated.”

“We know that fundamental rights often come into conflict with other constitutional values. And then they need to be considered, to know which will be predominant in a given situation… Freedom of expression, therefore, is not complete. And freedom of expression can and should be modulated according to the circumstances”.

“There are certain limitations to freedom of expression depending on whether or not the matter is under judicial secrecy and in a certain environment. […] It has to be assessed on a case-by-case basis”, he added, highlighting that this concept also applies to the electoral field.

Gonet stated this when responding to a question from Senator Rogério Marinho (PL-RN), leader of the opposition, about the case in which the video production company Brasil Paralelo was prevented from releasing, during last year’s electoral campaign, a film whose title was ” Who ordered Jair Bolsonaro to be killed?
