MP with the TCU aims at Deltan by agreement with the USA – 07/21/2023 – Mônica Bergamo

The Public Prosecutor’s Office at the Federal Court of Auditors (TCU) sent a representation to the court asking that alleged evidence of irregularities practiced by former prosecutor and former federal deputy Deltan Dallagnol during negotiations with US authorities at the time of Operation Lava Jato be investigated.

Deltan would have negotiated with the North Americans, in secrecy, an agreement to share the money that would be charged from Petrobras in fines and penalties due to corruption episodes, according to a report published by UOL. The negotiations would have taken place in the absence of the Comptroller General of the Union (CGU), which would be the competent body to deal with the allocation of the funds.

In the representation to the TCU, deputy attorney general Lucas Rocha Furtado claims that there are indications that the Brazilian government has been removed from the negotiations and says that the case would be more evidence that the TCU must act “in view of the history of poor performance by the components of Operation Lava Jato”.

“It is not today that I am surprised by the undue interference that Lava Jato prosecutors carried out in the operation”, says the deputy attorney general.

Deltan denies any wrongdoing. “Every day a new lying, distorted, mediocre and lazy article, made without verification by journalists who use supposed messages without any ethical criteria and turning a blind eye to the commission of crimes”, he said, through his social networks.

In addition to the request for an investigation by the court of accounts, Furtado highlights the large fine of US$ 853 million paid by Petrobras, in agreement with the US Department of Justice, and suggests that the negotiations should also be reviewed by the US Judiciary.

“It is not possible to accept that public managers act in an orienting way aiming to circumvent legal understandings of our country, nor to use artifices to personally dodge applied sanctions”, he says.

The deputy attorney general also requests that a copy of his representation be sent to the Organization of American States (OAS) for the adoption of measures and given “the need for political dialogue and cooperation with the North American Justice” to investigate the alleged irregularities.
