Minister Alexandre de Moraes, of the STF (Supreme Federal Court STF), denied this Tuesday (9) a request from the X network (formerly Twitter) in Brazil for the responsibility for legal measures to fall on X international. Moraes stated that the postulation “borders on litigation in bad faith”.
“The applicant company seeks a true jurisdictional immunity clause, for which there is no provision in the national legal order,” stated the minister.
“The fact that one of the so-called international operators is part of its membership suggests an abuse of legal personality, as it could choose not to comply with the determinations of the Brazilian Court without suffering any consequences, covered up by its representative in Brazil.”
In a request to the magistrate, lawyers for the Brazilian branch of the platform run by businessman Elon Musk claimed that the office does not have “any capacity to interfere in the administration and operation of the platform, nor the authority to make decisions regarding compliance with court orders in this regard “.
