Mayor of SP may lose nomination to the TCM for the Chamber – 06/16/2023 – Panel

Missing the deadline for submitting your nomination to occupy a vacancy as a member of the Municipal Court of Auditors could cause the mayor of São Paulo, Ricardo Nunes (MDB), to lose his prerogative to the City Council. With this, it is possible that he cannot choose a name that is exclusively his preference.

As the Panel showed, Nunes missed the 15-day period established by law (Article 12 of Law 9.167/1980) to send his nomination, which should have occurred by Thursday (15). The post has been unoccupied since May 30, with the retirement of Maurício Faria.

In view of this, it is discussed at the summit of the City Council that the context is similar to that of a bill that is sent to the Executive and has no response. In these cases, the project returns to the Legislature, which defines the sanction or veto.

In this way, an indication sent by Nunes can now be received in the Chamber with the answer that he did not meet the legal deadline and that, therefore, he lost his right.

The imbroglio may force the mayor to reach a joint solution with the mayor, Milton Leite (União Brasil), with whom he has been at odds over the nomination. The emedebista had been telling allies that the nomination would be his alone, without negotiations, while Leite complained that they had sealed an agreement in 2020 that the choice would be his.

In the new scenario, the emedebist may have lost the opportunity to nominate Marcela Arruda, the Management secretary who was his favorite for the nomination, but who faces resistance from Leite and allies of the mayor himself. The second on Nunes’ list, Ricardo Torres, from Fazenda, has more acceptance.

State deputy Milton Leite Filho (União) was the favorite of the mayor, who is his father. However, Leite should not insist on his own behalf with the possibility that the nomination now comes from the São Paulo Legislative.

Those involved in the proceedings say that the episode is illustrative of the isolation problems of the Nunes administration.

The mayor entered into open conflict with the TCM for disagreeing with the court’s determinations, clashed with Leite in relation to the appointment of the new councilor and has been criticized by allies for not consulting anyone in the decision-making process on the subject.

The mayor of São Paulo’s delay in nominating at least one interim councilor for the TCM has created obstacles to the operation of the capital’s court of accounts, as shown in the column.

Processes related to the health area in São Paulo had Maurício Faria as rapporteur and were not forwarded during the period.

On Thursday (15), the TCM decided that it will redistribute the processes among the directors, although they may soon be taken over by an interim and, later, by the new director.
