Full STJD review penalty and increase Bauermann’s hook to 360 days – 07/06/2023 – Sport

The STJD (Superior Court of Sports Justice) returned to judge this Thursday (6) eight athletes involved in a scheme of manipulation of Brazilian football games, revealed from the Maximum Penalty Operation, of the Public Ministry of Goiás. This time, the case was evaluated in the Plenary, the last instance of the sports court.

Some feathers have been revised. In the case of defender Eduardo Bauermann, the punishment increased. The former Santos player, currently at Alanyaspor, in Turkey, had his sentence extended to 360 days of suspension and was fined BRL 35,000. In the first instance, he had been penalized with a 12-match suspension.

In this Thursday’s session, it was defined that the auditors will ask the CBF (Brazilian Football Confederation) to communicate to FIFA (International Football Federation) and evaluate the possibility of asking that the decision have international reach. For now, the punishment is only valid in Brazilian football.

When commenting on the decision, the rapporteur Luiz Felipe Bulus stated that “it will only be possible to keep football alive in our country if we respond adequately to the highly serious infractions related to this issue”.

“We have communicated the result of the judgment to the CBF, and it will decide what it thinks is right. Communication with FIFA is at the discretion of the CBF”, added the president of the STJD, José Perdiz.

Bauermann was the only one to have his sentence extended. In the first trial, he had been framed in Article 258 of the CBJD (Brazilian Code of Sports Justice), which talks about “assuming any conduct contrary to sports discipline or ethics not typified by the other rules of this Code”. At the time, he was disqualified from Article 243 on “deliberately acting in a manner detrimental to the team he defends”.

Four players had their punishments reduced, and three other athletes had their sentences upheld:

Moraes (Aparecidense-GO)
First instance: 760 days and BRL 55 thousand;
Full: 720 days and BRL 55 thousand

Paulo Miranda (without club)
First instance: 1,000 days and BRL 70,000;
Full: 720 days and BRL 70 thousand (two infractions)

Fernando Neto (Sao Bernardo)
First instance: 380 days and BRL 15 thousand;
Full: 360 days and BRL 15 thousand

Kevin Lomonaco (Bragantino)
First instance: 380 days and BRL 25 thousand;
Full: 360 days and BRL 25 thousand

Gabriel Tota (Ypiranga-RS)
First instance: elimination and BRL 30 thousand;
Full: elimination and fine of BRL 30 thousand

Igor Carius (Sport)
First instance: acquitted;
Full: acquitted

Matheus Gomes (without club)
First instance: elimination and fine of BRL 10,000.
Full: elimination and fine of BRL 10,000.

In the cases of Gabriel Tota and Matheus Gomes, despite the elimination penalty, they still have a chance to play again. The CBJD (Sports Justice Code) provides that, after such a penalty, the player can appeal the decision to obtain the right to return to activities. For that, however, he has to go through a new trial at the STJD in order to prove that he deserves rehabilitation.
