Senator Flávio Bolsonaro (PL-RJ) defended businessman Elon Musk, owner of the social network X (formerly Twitter), amid the clash with Federal Supreme Court (STF) minister Alexandre de Moraes. The parliamentarian classified the fake news inquiry, led by Moraes, as a “big black hole”.

The parliamentarian highlighted that Musk “did not commit any crime” and “only asked the minister, who uses his social network, a question”.

“What starts wrong will end wrong. It’s not because it’s with Elon Musk now, this has been happening for more than five years with a totally illegal, unconstitutional and immoral inquiry, which was opened ex officio in the STF, shifting the jurisdiction of any Brazilian citizen to the Supreme Court against what it says the Constitution… Everything that happens in Brazil today is pulled into this big black hole that is the fake news inquiry”, said the senator in an interview with the program Roda Vivafrom the TV Cultura.

This weekend, Musk said he would not comply with the Court’s orders to keep profiles of those investigated for alleged anti-democratic acts blocked. The businessman also suggested that the minister “should resign or be impeached”. After the repercussions, the magistrate included Musk in the “digital militias” investigation.

Parliamentarians opposing the Lula government came to the billionaire’s defense. The senator stated that this agenda is not “right-wing against the STF”, but represents the “defense of freedom of expression”.

“An American citizen, a private company, from my point of view, did not commit any crime, he just spoke, took a position, asked a question to the minister who uses his social network… Elon Musk has no jurisdiction due to his role’s prerogative, everything is wrong. The minister once again makes a monocratic decision, before any act was committed, already including him in the investigation”, pointed out the senator.

For Flávio, Moraes acts with an “exaggerated and outside the law stance” in the investigation into fake news and its consequences. “The Federal Supreme Court must return to being a constitutional Court and not a criminal Court, as is happening now. The population’s perception is that they only look to investigate or try to muzzle a certain wing of politics within Brazil,” he said.

Asked about a possible impeachment of Moraes, Flávio highlighted that this is not the way to “solve the problem” in Brazil.

“I have always believed and continue to believe in self-regulation by the Supreme Court itself. I think this is an excellent opportunity for the Supreme Court to try to take back the reins of the Court, to stop being constantly sucked into a discussion that is not institutional, it is just relative to a minister so that things return to normal”, said the parliamentarian.
