Dino: whoever calls the STF an activist wants to instrumentalize it – 02/26/2024 – Power

Recently sworn in as minister of the Federal Supreme Court, Flávio Dino said this Monday (26) that the court does not have the objective of interfering in politics and that some of those who say she is an activist want to “instrumentalize the STF for their purposes “.

“If the Federal Supreme Court or any court is instrumentalized by a political position, whatever it may be, it has lost the meaning of existing”, stated the minister.

Dino’s speech was made at an event for freshmen at the IDP (Brazilian Institute of Education, Development and Research), which has Supreme Court Minister Gilmar Mendes as a partner.

The minister also said that if the Supreme Court were not so required to resolve issues related to the Powers, it would be a sign of its “irrelevance”.

Dino’s speech was made in the midst of a crisis, since last year, between the Supreme Court and Congress. Opposition parliamentarians have criticized the STF and said that the court is activist and invades the competence of other Powers.

Dino, who was the Minister of Justice and Public Security in the Lula (PT) government, took office at the STF last Thursday (22), taking the place of retired minister Rosa Weber.

Dino is the second appointed by Lula in the president’s current term. The first was Cristiano Zanin, who was the PT member’s lawyer in Operation Lava Jato actions.

The new magistrate is the first minister of the court, among those appointed since 1985, to have been elected to an Executive position before joining the court. Including the Legislature in the profile, after a gap of just over 25 years, Dino is the fifth nominee since redemocratization to have held an elected position.

When approved by the Senate for the court, last December, Dino received 47 votes in favor and 31 against — with two abstentions.
