About to leave the Senate to take up the post of minister of the Federal Supreme Court (STF), Flávio Dino (PSB-MA) said this Tuesday (20) that he had obtained a sufficient number of signatures that will make it possible to begin processing an Amendment Proposal to the Constitution (PEC) to remove the right to compulsory retirement of judges, prosecutors and military personnel who have committed serious crimes. The text presented also provides for their exclusion from public service.

The announcement that the PEC would be presented was made on Monday (19) during a speech in the Senate Plenary. The announcement that sufficient signatures had been obtained to process the matter was made via social media.

According to the senator’s office, 29 signatures were obtained for PEC nº 3/24, a number it received after it was filed at the Senate table.

Punishment

Compulsory retirement is applied as a form of “punishment” to judges, military personnel and prosecutors. At the postDino makes irony with the term, since, upon committing crimes and being convicted, they would be removed from office, but would continue to receive their remuneration.

If approved, the PEC will prohibit the granting of compulsory retirement to magistrates – as a sanction for committing a disciplinary infraction – and also prohibits the right to a pension for fictitious death. [simulada, falsa, suspeita, inverídica ou suposta] or presumed.

The text also prohibits the transfer of military personnel to inactivity as a sanction for committing a disciplinary infraction, as well as the granting of any benefit for fictitious or presumed death. In the case of serious misconduct, it provides, as a penalty, dismissal, licensing or exclusion, or equivalent, according to the respective legal regime.
