Dino follows Moraes and votes to convict 15 defendants in the first trial on 8/1

Federal Supreme Court (STF) minister Flávio Dino voted this Thursday (29) to convict another 15 defendants of the acts of January 8, 2023. This is the first time that Dino has participated in the trial of those suspected of participating in the invasion and depredation of the headquarters of the Three Powers. At the time of the acts, he served as Minister of Justice. The Court analyzes these 15 complaints from the Attorney General’s Office (PGR) in the virtual plenary session until 11:59 pm this Friday (1st).

In this modality, there are no debates and ministers simply cast their votes and indicate whether they follow or disagree with the rapporteur. Dino followed the understanding of Minister Alexandre de Moraes, rapporteur of the investigations, who proposed penalties ranging from 14 to 17 years in prison for the accused. Moraes also defended that the accused be fined R$30 million for the damage caused to public buildings.

So far, ministers Dias Toffoli and Cármen Lúcia have also followed Moraes’ vote. Minister Cristiano Zanin only voted for some of the actions and followed the rapporteur “with reservations”, defending lesser penalties for the defendants.

The accused are responsible for the crimes of criminal association, violent abolition of the democratic rule of law, coup d’état, qualified damage and deterioration of listed property. Since the beginning of the trials, the STF has already issued 101 convictions based on PGR complaints about the acts of January 8th.
