Manaus (AM) — The mandate of federal deputy Silas Câmara (Republicans) was revoked this Wednesday (31), by the Regional Electoral Court of Amazonas (TRE-AM), following a favorable score of 4 votes to 2. With the result of the session, the The parliamentarian’s legal advisor informed that he will appeal to the Superior Electoral Court (TSE).

“The decision was made by a small majority of votes and contradicted the previous position of TRE-AM itself, which approved the deputy’s accounts”,

he stated in an excerpt from the note published on social media.

The Public Electoral Ministry (MPE) accuses the pastor of the Assembly of God Church of illicitly raising or spending funds on aircraft charters in the 2022 elections.

The positive feeling for reversing the judgment is also highlighted in the note. The federal deputy will continue to carry out his activities and await definitive assessment by the Electoral Court. He also reaffirmed his commitment to the “legal defense of his mandate”, which was achieved with “work, union, for a holy purpose, in a clean and honest.”

Political analyst Carlos Santiago explained that, even after being impeached, the deputy will continue in office until the TSE’s decision. “Now, it is possible to appeal to the TSE (there are even embargoes, but delays), which has a suspensive effect”, he clarified.

The parliamentarian faces accusations of illicit expenditure of financial resources during the 2022 electoral campaign, with the chartering of aircraft. The MPE carried out a representation and requested the loss of mandate of the pastor of the Assembly of God.

Postponement of the session

The session that resulted in the revocation of Silas Câmara’s mandate had already been rescheduled last week. The vote should have been held last Wednesday (24), but was postponed until this Wednesday (31), following a request from judge Marcelo Vieira, head of the 8th Court of the Special Civil Court of the District of Manaus.

The request, according to Marcelo Vieira, was made due to the absence of a judge, who had voted in the trial and that this vote differed from that of the judge. Previously, the magistrate had already suspended the trial in December 2023.

Changes in the Chamber

The decision not only affects Silas Câmara’s fifth term, but also that of Adail Filho, who is part of the same party. As political analyst Carlos Santiago explained, the trial invalidated the votes, which totaled more than 125 thousand, of the federal deputy to count the electoral quotient of the Republicans, in the 2022 elections. As a result, the former mayor of Coari is left with insufficient votes of the caption.

If the TSE maintains the revocation, Silas will be ineligible for eight years. In addition, deputy Pauderney Avelino (União Brasil) and the state president of the Liberal Party (PL), Alfredo Nascimento, are expected to become effective. However, Avelino already occupies the position of Fausto Júnior (UB), after the deputy took over as the new secretary of the State Secretariat for Urban and Metropolitan Development (Sedurb), with this, there is the possibility of Pablo Oliva (UB) taking over the position.

“I can’t believe that Alfredo Nascimento and Pauderney Avelino are standing idly by. Not even former deputy Pablo Oliva is without hope, because with Pauderney Avelino and Fausto Júnior in the government of Amazonas, he can take over as a substitute”,

Case of ‘cracking’

The accusation of illicit spending was not the first case faced by Silas Câmara. The Attorney General’s Office (PGR) had already accused the federal deputy of embezzlement, a crime committed by a public official against the administration in general.

The action pointed to the diversion of Chamber resources to pay advisors, a practice known as “rachadinha”, during the period of 2000 and 2001. The parliamentarian was also accused of having appointed employees who carried out private activities as public servants.

In a decision, an agreement was established, validated by Minister Luís Roberto Barroso, between Silas Câmara and the PGR for the payment of a fine in the amount of R$ 242 thousand, in December 2022. The Federal Supreme Court (STF) closed the process after full compliance with the agreement.
