Former Brazilian player Daniel Alves, sentenced to four and a half years in prison for the rape of a 23-year-old girl in the Sutton nightclub, in Barcelona, ​​could be provisionally released if he pays bail of €1 million, equivalent to R$5.5 millions.

By two votes to one, the Barcelona Court partially agreed with Alves’ defense request to release him, pending the final sentence. The notification was given shortly before 12pm (8am in Brazil) this Wednesday (20).

The order imposes several conditions and precautionary measures. In addition to bail, the magistrates ordered the withdrawal of Alves’ two passports (Spanish and Brazilian). This way, after payment verification, your provisional release can be agreed.

If he leaves, the player is prohibited from approaching the complainant within a distance of less than one kilometer from his home, his place of work and any other place he frequents. You will also not be able to communicate with her through any type of means of communication.

The court prohibited Alves from leaving national territory and, in addition, imposed the obligation to appear before the Barcelona Provincial Court weekly and at all times when summoned and required by the judicial authorities.

The notification clarifies that Alves’ current imprisonment, pending the final sentence, “cannot under any circumstances anticipate the effects of a hypothetical sentence that may be imposed.” This point, stated in the order, requires, after a period of preventive detention, the assessment of personal circumstances and the possible need to maintain the measure.

The decision comes one day after the hearing was held in which Alves’ defense asked for his provisional release, claiming that he has already served a quarter of his sentence.

“I believe in justice, I’m not going to run away,” said Alves, in his defense, on Tuesday. The Public Prosecutor’s Office and the prosecution opposed the measure on the grounds that the football player has the financial means to escape. Defense lawyer Inés Guardiola argued, however, that he is domiciled and has roots in Barcelona.

According to Guardiola on Tuesday, Alves has already served a quarter of the sentence that the court imposed at the end of February — which, in the event of a final sentence, would enable him to begin receiving prison benefits — and stated that the Brazilian would not escape, sources said. legal.

The defense had proposed a bail of 50 thousand euros (R$ 273 thousand) and the delivery of passports. Alves, who was in prison, participated in the hearing via videoconference. Setting bail at €1 million could cause difficulties for the former player.

Just remember that, last year, to pay €150,000 (R$818,000) as a “damage repair mitigation”, Daniel Alves counted on the help of Neymar. The athlete has his assets blocked due to lawsuits in Brazil. The mitigating factor was used as a way for the defense to reduce the sentence. According to articles of the Spanish Penal Code, the mechanism can reduce the sentence by up to half.
