Cármen Lúcia: partner of 123milhas will go to the CPI as a witness – 09/04/2023 – Panel

Minister Cármen Lúcia (Federal Supreme Court) denied the request of the partners of 123milhas to be heard in the CPI of the Financial Pyramids as investigated, and not as witnesses, when there is a requirement that they take an oath committing to tell the truth.

As investigated, they would also have the right to decide whether or not to attend the CPI summons.

Cármen Lúcia states that the “convention, as a witness or being investigated, is an administrative attribution, constitutionally granted to the Houses of the National Congress, in the exercise of the investigative powers of the Parliamentary Commission of Inquiry.”

The minister also says that the parliamentary commission is an investigative one, “so its objective is to investigate in order to clarify and adopt measures regarding the conclusion that may come to pass”.

“It does not mean that, like any investigative body, they do not use witnesses who can clarify facts, present or corroborate evidence that is obtained to untie the issues to be verified”, he writes.

In the decision, the minister also rejects the request of the partners to issue a habeas corpus allowing people from the company’s administrative body not to be summoned.

According to Cármen Lúcia, “there is not enough information in the case file to prove the same legal situation as that of the patients, who were partially granted the injunction in this habeas corpus.”

The partners asked for the extension of the habeas corpus for Tânia Silva Santos Madureira, partner of the company HotMilhas, Cristiane Soares Madureira do Nascimento, administrator of the company Novum Investimentos e Participações S/A, partner of 123Milhas, Carolina Aquino, Director of Business Development at 123Milhas, Marcos Brandão, former executive consultant and former VP of Governance and Management at 123Milhas, Daniel Guerra, Senior Manager of Processes and Continuous Improvement at 123Milhas, Roger Duarte Costa, Fraud Prevention Manager at 123Milhas, and Matheus Divino, Planning Manager , Budget and Control of 123Milhas”
