Bolsonaro appeals to the Supreme Court against the TSE decision that made him ineligible

The defense of former president Jair Bolsonaro (PL) appealed to the Federal Supreme Court (STF) against the decision of the Superior Electoral Court (TSE) that made him ineligible. Before being sent by the STF, the extraordinary appeal must be filed with the TSE, as it depends on the approval of the president of the Electoral Court, Minister Alexandre de Moraes, to reach the Supreme Court.

Moraes may refuse to proceed with the action for procedural reasons. With this, the defense can present a new appeal to the STF, informed the g1 portal. The extraordinary appeal questions whether the decision of the TSE ministers respected the Constitution. In June, the electoral court made Bolsonaro ineligible for eight years, for abuse of political power and misuse of the media.

Last month, the TSE unanimously rejected the so-called embargoes filed with the Electoral Court questioning the decision against Bolsonaro. Now, the former president’s lawyers are trying to reverse the decision in the STF. The defense questions the inclusion of the so-called “coup draft”, found by the Federal Police (PF) in the home of former Justice Minister Anderson Torres.

The document suggested the possibility of establishing a state of defense at the headquarters of the Superior Electoral Court (TSE). The lawyers argue that the draft could not have been included in Bolsonaro’s judgment regarding the meeting with ambassadors in 2022, in which Bolsonaro questioned the security of the electoral system.

“The Board, in the position set out in the appeal, should have rejected the admission of the aforementioned ‘draft State of Defense decree’, as it is a ‘document’ produced after the results of the elections, with no direct relation to the subject matter of the action, which must be analyzed in the appropriate instances”, argued the defense. In June, Bolsonaro stated that he knew nothing about the draft found in Torres’ house. He highlighted that “a coup doesn’t have paper, it has a rifle”.
