Association goes to the STF against Tarcísio’s veto on elevator safety project – 10/12/2023 – Panel

The Brazilian Association of Elevator Companies (Abeel) filed a lawsuit with the Federal Supreme Court against the Government of São Paulo, after vetoing a project approved by the Legislative Assembly that increases safety requirements for the use of equipment.

The project, by former deputy Dr. Damaris Moura (PSDB), was approved in December last year. The text makes an addition to the current State Fire Protection and Emergencies Code, now requiring firefighters’ reports to take into account the Annual Inspection Report (RIA) of elevators.

Furthermore, the report must be produced by a company accredited by the state’s Crea (Regional Engineering and Agronomy Council).

“Of the approximately 950 elevator maintenance companies in the state of São Paulo, only approximately 170 are regularly incorporated and registered with Crea and the city hall, which puts the lives of the user population even more at risk”, says the deputy.

She says she presented the project after an elevator crash in Santos in 2019, which killed four people from the same family.

When vetoing the project, governor Tarcísio de Freitas (Republicans) justified that this topic is of local interest, and must be regulated by municipalities, not by the state.

The association then filed a lawsuit, based on a formal argument, that the governor would have missed the 15 working day deadline to sanction or veto the law.
