Zambelli appoints as defender the lawyer who accused Moraes – 02/09/2023 – Politics

Federal deputy Carla Zambelli (PL-SP) appointed on Friday (1st) lawyer Arthur Hermógenes Sampaio Junior to represent her in an action being processed against her in the Electoral Court.

In November last year, Sampaio filed a crime report at the STM (Superior Military Court) against the minister of the STF (Federal Supreme Court) and president of the TSE (Superior Electoral Court), Alexandre de Moraes.

The request was denied on the grounds that it was outside the jurisdiction of the court.

The lawyer asked that Moraes be investigated for the alleged practice of abuse of authority and the crime of prevarication, as stated in the decision. To justify the actions of the military court, Sampaio invoked Article 142 of the Constitution, using “moderating power” in his arguments.

Also last year, Sampaio filed a habeas corpus at the STJ (Superior Court of Justice) against Moraes’ act at the TSE, requesting that he could enter the polling station without having to hand over his cell phone to the pollster.

Zambelli is the target of four Aijes (electoral judicial investigation action), a type of action that, in addition to impeachment, also has the possible consequence of ineligibility for eight years, starting from the 2022 elections. actions being processed by the TRE (Regional Electoral Court) of São Paulo.

In early July, lawyer Karina Kufa stopped representing her in a series of lawsuits, including electoral ones.

In all, her office acted in more than 40 lawsuits filed against the congresswoman, in addition to a smaller portion of about 20 lawsuits initiated by the congresswoman, covering the civil, electoral and criminal areas. Kufa also acts as a lawyer for former President Jair Bolsonaro (PL).

Two of the lawsuits targeting Zambelli are being processed by the TSE. They were presented by today’s President Lula’s coalition (PT) against Bolsonaro’s ticket, in addition to several of his allies.

Another two target only the congresswoman and were filed at TRE-SP. Both were sent to the TSE, to be processed together with the actions filed in court, under the understanding that there was a connection between the themes.

In July, however, by decision of the TSE Minister and Electoral Inspector General, Benedito Gonçalves, they were sent back to the TRE. One of these actions was filed by federal deputy Sâmia Bomfim (PSOL-SP), while the other, in addition to Bomfim, has federal deputy Glauber Braga (PSOL-RJ) as the plaintiff.

Two of the actions calling for the ineligibility of the deputy claim that she would be part of an “ecosystem of Bolsonarist disinformation”, which would act to “usurp themes of public debate”.

The authors of the request argue that there would be a set of profiles on social networks acting for the acute propagation of misinformation against the candidacy of the PT, against the integrity of the electoral system and in favor of the candidacy of Jair Bolsonaro (PL).

Two other interpellations focus on attacks on the electoral system and the regularity of elections, in which, for example, a video from late November is cited in which she addressed generals, asking them not to accept the election result.

In the records, still under the previous lawyer, Zambelli’s defense claimed, in general terms, that the requests for actions be considered invalid, questioning the arguments and evidence presented. They argue that the congresswoman’s conduct did not characterize abuse of political or economic power or misuse of social communication media.
