Homeless resident Geraldo Filipe da Silva, 27, who obtained a majority for his acquittal in a trial at the STF (Supreme Federal Court) this Thursday (14), had been detained alongside the group that vandalized the headquarters of the three Powers on January 8, 2023 and always said he went there out of curiosity, because of helicopters.

In testimony in the case, he stated: “I saw helicopters flying over the area, as I walked around that area a lot, I went there out of curiosity. And I ended up being detained.”

When arrested, Geraldo said that he had lived in the Federal District for three years and that he had left Pernambuco

After a lawyer who voluntarily took on Geraldo’s defense pointed out that there was no evidence that he was part of the group that defended a coup d’état and destroyed public property, the PGR (Attorney General’s Office) itself reversed itself and asked him to was acquitted.

“There is not enough evidence to support the assertion that the accused joined the masses, maliciously adhering to their objectives, with the intention of taking power and destroying the Planalto Palace, the National Congress and the Federal Supreme Court”, said the minister Alexandre de Moraes in his vote.

The PGR filed at least 1,400 complaints against those accused of the coup attacks, but some of them could benefit from criminal prosecution agreements, which would avoid trials by the STF.
