US court decides on BRL 1 billion case with former senator – 01/25/2023 – Mônica Bergamo

A US court has determined that businesswoman Carolina Andraus Lane has access to financial transaction documents from a trust shared with her ex-husband, former Senator Gilberto Miranda.

They are fighting a dispute in court for an estimated fortune of R$ 1 billion. Lane accuses her ex-husband of having changed the contract of an investment that would have been built by the two, when they were still together, and of having appropriated the money.

The parliamentarian’s lawyer, Rui Celso Fragoso, argues that Lane and Miranda were married under a regime of total separation of property and, therefore, the businesswoman would not be entitled to the money.

Two judges from the states of New York and Florida determined that the office of the American lawyer who took care of the couple’s trust, Donald Fox, make available the documents requested by the businesswoman’s defense.

The magistrates also ordered the banks in which the investment was allocated – such as Morgan Stanley, Deutsche Bank and Royal Bank of Canada RBC – to provide documentation of the fund’s financial transactions.

According to the businesswoman’s defense, the records are proof that she was a beneficiary of the trust. The objective is that the documents are presented in a process that runs in the Brazilian Justice.

In the de facto partnership action, the businesswoman was defeated in the first and second instances at the São Paulo Court of Justice, but appealed to the Superior Court of Justice (STJ).

The former senator’s lawyer, Rui Celso Fragoso, claims that the new documents “are completely irrelevant”.

Gilberto Miranda was a senator for Amazonas for three terms and has already been the target of actions by the Federal Police, but he was never convicted.

The former parliamentarian and Carolina Andraus Lane were married for 12 years and lived in mansions in the Jardins region, in São Paulo, where they received politicians and personalities from the São Paulo elite.
