Tony Garcia goes to the CNJ against judge Gabriela Hardt – 07/13/2023 – Panel

Businessman and former state deputy Tony Garcia filed a disciplinary complaint with the CNJ (National Council of Justice) against federal judge Gabriela Hardt, who until last month acted as a substitute in the 13th Court of Curitiba.

In the document, Garcia’s lawyers reinforce the thesis that the judge would not have taken action in relation to the accusations he made against former judge Sergio Moro and public prosecutors, during a court hearing held in March 2021.

“A violation of the principle of morality and the duty imposed by article 40 of the CPP is perceived, insofar as the magistrate remained inert even in the face of news about potentially criminal facts”, says an excerpt from the disciplinary complaint, which is accompanied by by recording the interrogation on video.

The case only came to light last month, when Garcia began giving press interviews about the content of his testimony. Subsequently, Hardt reported that he filed a criminal complaint with the MPF (Federal Public Ministry) against Tony Garcia for a crime against honor and withdrew from his processes.

Tony Garcia signed a collaboration agreement in 2004, but at the end of last year, Hardt rescinded the accusation, complying with a request from the MPF made in 2019.

At the 2021 hearing, when Garcia was still trying to convince Hardt that the termination of his accusation would be unfair, he would have revealed that he was forced to illegally record authorities at the request of prosecutors and Moro after signing an award-winning collaboration agreement.

But the content of his report to Hardt was sent to the STF (Federal Supreme Court) only in April of this year, by decision of the titular judge Eduardo Appio, currently removed by order of the Special Administrative Court of the TRF4 (Federal Regional Court of the 4th Region).

Today a senator for União Brasil, Moro has said that the businessman makes a “lying report and dissociated from any support in reality or in any evidence”.

Garcia entered into a plea deal when he was accused of fraudulent management of the National Garibaldi Consortium and ended up arrested in 2004. He agreed to carry out an award-winning collaboration, at the end of that year, with prosecutors from the task force of the Banestado case with the 2nd Federal Court of Curitiba (current 13th Court).
