Toffoli says he will ask for a review and judgment on guarantees judge will be suspended

The Minister of the Federal Supreme Court (STF) Dias Toffoli announced this Thursday (22) that he will ask for a review of the judgment that analyzes the constitutionality of the guarantees judge. Toffoli said that he will wait for the rapporteur, Minister Luiz Fux, to finish voting and that his request does not prevent other colleagues from advancing their votes.
“I had already spoken with Minister André Mendonça who is the first to vote after the rapporteur and I apologize for the eminent colleagues with whom I have not yet had the opportunity to talk… I’m going to ask for a visa, committing myself to return it in the first week of August”, said Toffoli.
According to the internal regulations of the Court, ministers have a period of up to 90 days to analyze the cases when they request a view. After this period, the process returns to the system to be judged.
This afternoon’s session began with the continuation of the rapporteur’s vote. This Wednesday (21), Fux questioned the legality of the anti-crime package, which created the mechanism, and argued that more in-depth studies be carried out on the subject.
