The Minister of the Federal Supreme Court (STF) Dias Toffoli annulled this Monday (19) the evidence obtained from the Odebrecht leniency agreement against the former Minister of Planning Paulo Bernardo.
He is accused of passive corruption and money laundering under contracts signed at Empresa de Trens Urbanos de Porto Alegre S/A (Trensurb). The lawsuit is pending at the 22nd Federal Criminal Court of Porto Alegre (RS).
The minister’s decision was taken after the former minister’s defense asked for an extension of the decision that annulled the evidence against lawyer Rodrigo Tacla Duran, defendant for money laundering in proceedings arising from Operation Lava Jato, reported Agência Brasil.
When analyzing the defense’s request, Toffoli agreed that the accusations against Paulo Bernardo are also based on the analysis of the Drousys and My Web Day systems, used by Odebrecht to record bribe payments and which were considered illegal.
“In total, the exordial contains 37 references to the mentioned systems throughout its 51 pages. The same can be seen in the decision that admitted the processing of the complaint, by enshrining, as crucial elements of conviction, the Odebrecht systems obtained through the agreement of leniency”, decided the minister.
