STF sends lawsuit against Bolsonaro to the first instance

Ex-president charged with inciting rape

Minister Dias Toffoli, of the Federal Supreme Court (STF), sent this Monday (19) to the Justice of the Federal District the second criminal action in which former president Jair Bolsonaro is accused of inciting the crime of rape.

The case involves the speech given by Bolsonaro in the plenary of the Chamber of Deputies in December 2014, when he was a federal deputy.

At the time, the then parliamentarian said that he would not rape deputy Maria do Rosário (PT-RS) because “she didn’t deserve it”. The following day, he repeated the statement in an interview with the newspaper Zero hour.

After the statements, Bolsonaro was sued by the Federal Public Ministry (MPF) and by Maria do Rosário.

Today’s decision sends the MPF process to the Federal District Court. Last week, the process filed by the deputy also went to the first instance.

Bolsonaro began to respond to the accusations at the Supreme Court, but the process was suspended after he took over the Presidency of the Republic in 2019. With the end of the mandate and the privileged forum, Toffoli determined that the case proceed to the first instance of Justice.

After the episode, Bolsonaro’s defense claimed that he did not incite the practice of rape, but only reacted to offenses uttered by the deputy against the Armed Forces during a ceremony in honor of human rights.

For lawyers, the clash between Maria do Rosário and Bolsonaro took place within Congress and should be protected by the constitutional rule of parliamentary immunity, which prevents criminal imputation of their statements.
