TCU judges Dweck and Nelson Barbosa for riding Dilma – 03/27/2023 – Panel

This Wednesday (29) the TCU (Tribunal de Contas da União) judges the accountability of the Minister of Management and Innovation, Esther Dweck, and the director of BNDES, Nelson Barbosa, on the tax pedaling that resulted in the impeachment of the former President Dilma Rousseff (PT).

The MP (Public Prosecutor’s Office) for Accounts asks for the condemnation of the two, with disqualification from holding public office for five years, counting from the court’s decision. If it is the winning understanding, both will need to be removed from the functions they currently perform.

The technical area accepted the minister’s justifications, who at the time was Federal Budget Secretary, and determined her exclusion from the process. Prosecutor Júlio Marcelo de Oliveira, however, disagreed and understood that she had a malicious participation in the edition of the decrees that opened supplementary credit in 2015 without authorization from the National Congress.

“In the view of the MP for Accounts, this conduct reveals more than a gross error, with serious breach of the duty of care. It is, in fact, a willful conduct, with perfect awareness that a required condition was being frontally breached” , sustains.

With regard to Nelson Barbosa, at the time, the Minister of Planning, the attorney and the technical area agreed on the conviction. Disqualification from public office and payment of a fine are recommended.

The opinion of the MP de Contas was completed in October 2022. The process was reported by Minister Raimundo Carreiro and was inherited by Antônio Anastasia, who replaced him, and now takes the discussion to the plenary.

Cycling was considered illegal in April 2015, when TCU ministers asked 17 government officials for explanations. Former Minister of Finance Guido Mantega was one of those prohibited from exercising public functions by the court.

They are one of the reasons for rejecting the 2014 and 2015 accounts of former president Dilma Rousseff (PT). But in this original pedaling process, Dilma was not investigated.
