Federal deputy Tabata Amaral (PSB) lost a lawsuit against the man who threatened her with a “baseball bat in the face”. She was ordered to pay R$5,000 in procedural costs and fees to Renato Tonini’s lawyer.
Tabata filed a criminal complaint against Renato Tonini for incitement to crime and defamation on a social network. In April 2021, he wrote on Instagram: “We have to give her the most effective beauty treatment in the world: the baseball bat in the face. So efficient that even her mother won’t recognize it afterwards”.
On social networks, Tabata regretted the decision of the São Paulo Court of Justice. “Hatred, machismo and impunity win, we lose all women”.
The case was analyzed in the first and second instance, but was denied. The judges and judges say that Renato Tonini’s posts did not constitute a crime for “absence of evidence of authorship and absence of just cause”.
Tabata’s defense took the case to the STF, which did not analyze the action due to “procedural issues”. The decision is made by Minister Rosa Weber.
“Analysed the records, it appears that, in order to go beyond the understanding of the Court of origin, it would be necessary to analyze the case in the light of the interpretation given to the pertinent infraconstitutional legislation and to reexamine the facts and evidence of the records, which is not appropriate in the context of of extraordinary appeal, as the affront to the constitutional text”, says the minister’s decision.
