STJ determines that INSS experts maintain minimum activity during strike – 01/30/2024 – Panel

Minister Og Fernandes, acting as Presidency of the STJ (Superior Court of Justice), granted this Tuesday (30) an injunction determining a minimum percentage of activity for INSS (National Social Security Institute) medical experts during this Wednesday’s strike -Friday (31).

The request for precautionary relief was filed by the Union against the ANMP (National Association of Federal Medical Experts). Fernandes established two percentages of continuity in the provision of public services, determined according to the average waiting time for scheduling inspections.

The percentage should be 85% for Alagoas, Amazonas, Amapá, Bahia, Ceará, Federal District, Espirito Santo, Goiás, Maranhão, Mato Grosso, Pará, Paraíba, Pernambuco, Piauí, Paraná, Rio Grande do Norte, Rondônia, Sergipe and Tocantins —in these locations, the average waiting time is more than 45 days, a period established by law.

With an average waiting time of less than 45 days in December, Acre, Minas Gerais, Mato Grosso do Sul, Rio de Janeiro, Roraima, Rio Grande do Sul, Santa Catarina and São Paulo should maintain 70% of expert doctors in activity. federal.

In case of non-compliance with the decision, the minister imposed a daily fine of R$500,000.

“Considering the essential nature of the activities involved, related to the issue of public health and the survival of the population affected by the movement, and without passing judgment on the merits of the legality or otherwise of the strike movement, in a summary cognition examination, I understand that the necessary requirements for granting the intended precautionary protection, with the applicant being partially justified in relation to the minimum percentages of maintenance of medical expertise services to be observed to guarantee the continuity of the essential service”, he wrote.

The experts demand a 23% salary increase and a competition to hire at least 1,500 new experts, among other points.
