STF suspends trial of time frame with tied score

Sao Paulo-SP) – The Federal Supreme Court (STF) suspended this Wednesday night (30) the trial of the time frame for the demarcation of indigenous lands with the score tied 2-2.

With Minister Rosa Weber’s decision, voting will resume this Thursday (31) with the final part of the thesis by Minister André Mendonça, who voted in favor of the measure. Next, the next to vote will be Minister Cristiano Zanin.

So far, ministers Alexandre de Moraes and Edson Fachin have voted against the constitutionality of the time frame, while Mendonça and Kassio Nunes Marques have defended the thesis.

With a long vote, Mendonça justified his decision by explaining that the timeframe is the solution that best “balances” the interests of indigenous peoples and ranchers in the fight for land, in addition to defending the need for an objective framework for the issue.

“It is not intended, with this, to deny the regrettable and recorded here historical events that unfortunately effectively permeated the relations between indigenous and non-indigenous”,

justified.

According to Mendonca, “it is not about denying the atrocities committed, but rather understanding that the look at the past must have as a perspective the possibility of a reconstruction of the present and the future”. “I understand that this solution is found based on my reading of what the text was and the intention of the original constituent, to bring a stabilizing force from its enactment”completed.

The trial has been dragging on since September 2021 and had been suspended last June, following the request for a view submitted by Mendonça, appointed by Jair Bolsonaro . The ruralist caucus in Congress defends the measure, which is criticized by the Minister of Indigenous Peoples, Sonia Guajajara, and of the Environment, Marina Silva, and by the Articulação dos Povos Indígenas do Brasil (Apib).

The process that motivated the debate in the STF has to do with the dispute over the ownership of the Ibirama Indigenous Land, in Santa Catarina, which is questioned by the state Public Ministry. (ANSA).
