Commission approves project reported by Dorinaldo on public civil action against manager if there is damage to indigenous education – News of Brazil

The Commission for the Amazon and for Original and Traditional Peoples of the Chamber of Deputies approved Bill 277/22, which creates a public civil action of educational responsibility so that managers are held accountable for actions or omissions that compromise public indigenous school education.

The rapporteur, deputy Dorinaldo Malafaia (PDT-AP), recommended approval. “The right to public indigenous school education is guaranteed by the Constitution, and the Law of Guidelines and Bases of National Education determines the provision of bilingual and intercultural school education to indigenous communities”commented the rapporteur.

The approved text inserts a provision in the Public Civil Action Law, which deals with liability for damage to the environment, to the consumer and to goods and rights of artistic, aesthetic, historical, tourist and landscape value. The change affects all federative entities (Union, states, Federal District and municipalities).

“Unfortunately, we still see problems with the irregular offer or even the school exclusion of children belonging to indigenous communities”said the author of the proposal, former deputy Joenia Wapichana (RR). She recalled that the Public Ministry repeatedly questions the performance of public managers. The project is being processed in a conclusive manner and will still be analyzed by the Constitution, Justice and Citizenship Commission.
