Salomão makes extraordinary corrections in the judge’s office – 08/31/2023 – Frederico Vasconcelos

The national justice inspector, Minister Luis Felipe Salomão, determined the establishment of an extraordinary correction in the office of the judge Evandro Reimão dos Reis, of the Federal Regional Court of the 6th Region, in Belo Horizonte.

The correction, chaired by Salomão, will take place between this Wednesday (30th) and Friday (1st). It will be processed under secrecy of justice.

On August 1, federal judge Diana Maria Wanderlei da Silva, from the Federal District, filed a disciplinary complaint with the CNJ to determine whether Reimão violated the Code of Ethics for the Judiciary, taking advantage of the position he holds.

Reimão had filed a criminal complaint against Diana, alleging that the magistrate had suppressed a public document from the records of a class action. The judge understood that there was interference by the judge to limit his independence.

She requested the Federal Public Ministry to analyze whether Reimão committed slanderous denunciation, the crime of slander and procedural coercion.

Diana denies deletion of public document. She alleges that there was immediate cancellation of the “dispatch of procedural impulse”, prior to the sentence. The signature by mistake took place on April 4 at 16:11. A minute later, she requested the cancellation of the dispatch to the press office. The cancellation was confirmed at 4:20 pm.

On April 24, it extinguished the process without deciding on the merits, understanding that “there is no right to be protected by the popular action procedure”, and “inadequacy of the chosen path”.

Origin of facts

The judge is the author of a class action that he filed in March 2022. It deals with the alleged unjust possession of Federal Union property by defendants who claim compensation for land owned by the Public Power. The value of the cause is R$ 150 million.

Judge Diana maintained in the records that the judge’s objective is to remove her from the case as natural judge. In a popular action, the magistrate asks for “compensation of the expenses he claims he had with the cause”. The judge reproduced a private contract between the plaintiff and a lawyer, “whose contractual fees were agreed upon at R$ 11.9 million”.

Diana recorded that the judge “required the conviction, equally, of all defendants to pay the author of all judicial and extrajudicial expenses [serviços contratados]such as travel, accommodation, photocopying, expertise”.

How will the correction

Judge Mauro Pereira Martins, CNJ counselor and member of TJ-RJ, was appointed to carry out correctional activities; judge Joana Carolina Pereira, from the TRF-5, and the auxiliary judge of the national internal affairs department, Cristiano de Castro Jarreta Coelho, from the TJ-SP.

The TRF-6 should provide a place for the hearing of people and access for the National Internal Affairs team to the court’s premises, with the support of employees in the information technology sector.

It must also indicate employees of the functional registration, payment and information technology sectors to provide documents, whether confidential or not.

The Corregedoria issued letters to the Attorney General of the Republic, the Federal Public Defender General and the Minas Gerais section of the Brazilian Bar Association.

“I don’t know what it is, because I wasn’t informed”, said the judge Evandro Reimão dos Reis in a message. “I owe nothing. I fear nothing. I am one of the most productive and ethical judges at TRF-6”, he said.

Judge Diana Maria Wanderlei da Silva did not comment on the correction.

The Regional Attorney of the Republic of the 1st Region reported that the case is being processed in secrecy.
