STF opens inquiries to investigate Sílvia Waiãpi and two other deputies for acts of January 8 – News of Brazil

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), complied with the request of the Attorney General’s Office (PGR) and ordered the opening of three investigations to investigate parliamentarians for allegedly acting and inciting the terrorist acts of January 8, in Brasília .

The three Bolsonarist deputies Clarissa Tércio (PP), André Fernandes (PL) and Silvia Waiãpi (PL) will be investigated for the crimes of terrorism, criminal association, violent abolition of the Democratic State of Law, coup d’état, threat, persecution and incitement to crime .

The records must be forwarded to the Federal Police so that, within the initial period of 60 days, it can gather the necessary elements for its conclusion, carrying out the inquiries and carrying out the other steps necessary to elucidate the cases.

Case by case

What motivated the complaint of Sílvia Waiãpi by the PGR was a video published on Instagram in which the indigenous woman incites coup acts saying: “People take the Esplanada dos Ministérios this Sunday! Seizure of power by the Brazilian people dissatisfied with the red government”. Moraes accepted the complaint and stipulated a period of 60 days for the Federal Police to carry out an investigation.

On January 8, 2023, federal deputy Clarissa Tércio released a video on her Instagram account in which she encouraged the practice of acts. At the time she said: “We just took power. We are inside Congress. All people are up here. This will go down in history, the history of my grandchildren, my great-grandchildren.”

Thus, the Minister of the STF considered that “the normative structure of the crime of incitement to the crime of preventing or restricting the free exercise of the Three Powers of the Union, at the level of its typical objective assumptions, is all fulfilled, being unnecessary the demonstration of a causal link between the content of the post and the dangerous situation that effectively led to the injury of the protected legal interest”.

The complaint against Deputy André Fernandes ran due to two publications on Twitter. First, on January 6, Fernandes released a video calling for the acts to take place on January 8. “This weekend, at Praça dos Três Poderes, the first act against the Lula government will take place. We will be there”, wrote the elected deputy.
